This principle of “Command Responsibility” was established during the Nuremburg and Tokyo trials following the Second World War, is codified in the Geneva Conventions and has been refined by the International Criminal Tribunal for the former Yugoslavia.

The Charges

Kosovo
In a 42 page Indictment, Slobodan Milosovic is charged with forced deportations of the ethnic Albanian population of Kosovo, other inhumane acts, murder and persecutions.

Quoting from the Indictment:
“ By June 1999, approximately 800,000 Kosovo Albabians, about one-third of the entire Kosovo Albanian population, had been expelled from Kosovo. Thousands more were believed to be internally displaced. An unknown number of Kosovo Albanians were killed in the operations conducted by the FRY and Serbia.” (The FRY is the Federal Republic of Yugoslavia.)

More than 4,000 bodies have already been exhumed from mass graves in Kosovo and an as yet undisclosed number in other parts of Serbia. The Prosecution expects more bodies to be recovered, bringing the total to more than 8,000.
