The video alone is not sufficient evidence to convict Mr. Tsvangirai. Additional corroborative evidence would have to be presented, by the Prosecution, in order to support any charge, particularly such a serious crime as Treason, which carries with it the possibility of the death penalty.

In addition, the video itself is highly questionable. First, it was made by Dickens and Madson, which is associated with the Zimbabwean Intelligence Services and has close ties to President Mugabe.

The Daily News, an independent Zimbabwean newspaper reports that in a recent interview on the Canadian Broadcasting Corporation’s “As It Happens” program, host Bill Cameron interviewed Mr. Ben-Menasche, who described himself as a “friend” of Robert Mugabe.

Mr. Cameron also commented: “I’ve been looking through the transcript of the Australian broadcast, and I can’t find a record of Mr. Tsvangirai asking you to kill Mr. Mugabe.”

Mr. Ben-Menashe replied: “Well, I believe . . . I believe there . . . words used, elimination and things.
I have not seen the Australian SBS programme, but I have seen the tape that was made. It’s five or six hours long. They have it. It’s clear. It’s available to whomever wants to see it and hear it. It’s clear that that’s what he’s asking for.”

Mr. Ben-Menashe said Mugabe was a victim of British neo-colonialism. “This is why the British are very upset about this tape. They can’t refute it.

They’re attacking me personally, they’re saying the tape is a forgery or a thing. I say hold on a second. Personally, okay, you want to attack me, that’s fine. The tape, you’re saying it’s a forgery. Look at it. Test it.”
