The truth or falsehood of these claims does not excuse the atrocities committed by the Serbian forces in Bosnia-Hercegovina, Croatia and Kosovo. They may, however, shed some light on the motivation behind Serbian actions – a “Last Stand” against unrestricted Capitalism.

Germany, Great Britain, the United States and NATO, however, are not on trial in The Hague. Perhaps, they should be. Perhaps, they will be.

The simple fact is that it is Slobodan Milosovic who is now on trial and must answer the charges brought against him. Although he may not recognise the validity of the ICTY, his detention and trial are a reality and his only hope of being released lies in the judicial procedures before him.

Mr. Milosovic’s contends that the Croatian, Bosnian and Kosovo Wars were all a result of the machinations of Germany, Great Britain, the United States and NATO, in a plot to colonize and occupy the Balkans.

Nevertheless, disturbing as this may be, it does not exonerate the former president from the charges brought against him. Only the presentation of evidence before the Tribunal Trial Chamber may – or may not – provide a clear picture of the actual causes of the sufferings of Yugoslavia.

The three Judges for the ICTY must then determine from the evidence presented before them, whether or not Mr. Milosovic is Guilty, as charged, or Not Guilty, as charged.

Based upon the principle of “Command Responsibility”, wherein an individual in a position of authority is held accountable for the actions of his or her subordinates, it is difficult to see how Mr. Milosovic, as President of Yugoslavia, can be found “Not Guilty” of at least some of the charges against him.
