U.S. Interior Secretary Gale Norton approved the filing of a report that deliberately misled U.S. District Court Judge Royce C. Lamberth about her efforts to reform the management and administration of the Individual Indian Trust. The Trust holds 11,000,000 acres of land and other natural resources – including oil, gas, coal, and timber – for the benefit of 500,000 individual Indians throughout the western United States. The report filed by Special Master Alan Balaran today is supported by 5 volumes of exhibits which detail the malfeasance of Secretary Norton just 3 days
before the U.S. Court of Appeals hears the Secretary’s appeal from the September 17, 2002 decision of Judge Lamberth that held the Secretary in contempt for perpetrating fraud on the court.
Special Master Balaran found that the Secretary approved the deliberately misleading report during the contempt trial last year “to avoid liability at all costs” and evade the contempt charges that were filed by plaintiffs in Cobell v. Norton, the largest class action case ever filed against the United States government.
